6. Transfers outside the European Economic Area
Some of our processors are based in the United States or other third countries. In such cases we ensure one of the following safeguards under Articles 44–50 GDPR:

After expiry of these periods we securely delete or anonymise the data so it cannot be attributed to a specific individual.
8. Automated decision-making and artificial intelligence
Our products use artificial intelligence (AI) for personalisation, content generation, next-step recommendations, etc. We want to be transparent with you:
8.1 Where you encounter AI
- AI Team — your AI agents generating texts, images, responses.
- A.I.Q. personalisation — adapting website and email content based on your quiz answers.
- Chatbot/voicebot — automated communication on the website or by phone.
- AI in the Platform — generating responses, message suggestions, summaries.
8.2 Whether “automated decision-making” takes place
We do not make any significant decisions about you solely on an automated basis without the possibility of human review. In particular:
- AI may recommend text, an offer or a next step — the final decision (e.g. closing a deal) is made by you or your sales person.
- Where our AI in turn communicates with your customers (via the Platform), you decide as the operator — this is governed by your own privacy policy and our DPA.
You have the right to object to processing based on profiling (Article 22 GDPR) — see clause 9.
8.3 That you are communicating with AI
Where a chatbot, voicebot or other automated system communicates with you within our services, we will expressly alert you — either by an introductory message or by graphic identification. You may at any time request to be transferred to a human, in compliance with Article 50 of the AI Act.
8.4 AI and training data
We do not use your personal data to train AI models. Where third-party AI models (OpenAI, Anthropic, etc.) are used via our Platform, their training data policy is governed by their own terms — in our agreements we have prohibited training use of data where suppliers permit (enterprise/commercial tier).
9. Your rights
As a data subject you have the following rights in connection with the processing of your personal data:
9.1 Right of access (Article 15 GDPR)
You may ask us what data we process about you and we will provide you with a copy.
9.2 Right to rectification (Article 16 GDPR)
If you find that your data is inaccurate, you have the right to have it rectified.
9.3 Right to erasure / “right to be forgotten” (Article 17 GDPR)
You may request deletion of your data where:
- it is no longer necessary for the purpose for which it was processed;
- you withdraw consent (and there is no other legal basis);
- you successfully object;
- the data was processed unlawfully;
- there is a legal obligation to delete it.
We cannot delete data where retention is legally required (typically accounting records for 6 years).
9.4 Right to restriction of processing (Article 18 GDPR)
You may request that we temporarily stop actively processing your data (for example pending resolution of your objection).
9.5 Right to portability (Article 20 GDPR)
You have the right to receive your data in a structured, commonly used, machine-readable format (CSV/JSON) and to transmit it to another controller.
9.6 Right to object (Article 21 GDPR)
Where we process your data on the basis of legitimate interest (typically marketing to existing customers), you may object — and we will stop the processing unless we have compelling grounds to continue.
9.7 Right to withdraw consent
If you have given us consent (typically for marketing), you may withdraw it at any time — withdrawal does not affect the lawfulness of processing before withdrawal.
9.8 Right not to be subject to automated decision-making (Article 22 GDPR)
See clause 8 above.
9.9 How to exercise your rights
Just write to us at info@cliqsales.com. We may need to verify your identity. We will respond no later than 30 days from receipt of your request (in complex cases we may extend this period by a further 2 months, of which we will inform you).
Handling your request is free of charge. For repeated or manifestly unfounded requests we may charge a reasonable fee or refuse the request.
9.10 Right to lodge a complaint
If you consider that we are not processing your data in accordance with the law, you may lodge a complaint with the Data Protection Commission:
- Address: 21 Fitzwilliam Square South, Dublin 2, D02 RD28, Ireland
- Website: dataprotection.ie
- Telephone: +353 (0)761 104 800
We would, however, be glad if you would try to reach out to us first — most situations can be resolved promptly.
10. Security of your data
We implement appropriate technical and organisational measures to protect your data, including in particular:
- Encryption in transit (TLS 1.2+) and at rest (AES-256).
- Two-factor authentication for access to the Platform.
- Access controls on a “need-to-know” basis — only authorised personnel access your data.
- Regular security audits and updates.
- Backup and recovery procedures.
- Contractual confidentiality of all personnel and suppliers.
- Security training of personnel.
In the event of a personal data breach which may pose a significant risk to your rights, we will notify you without undue delay and report the incident to the Data Protection Commission in accordance with Article 33 GDPR.
11. Children and minors
Our services are not intended for persons under 16 years of age. We do not knowingly process the data of such persons. If you become aware that we have received data from a person under 16, please contact us at info@cliqsales.com — we will delete the data immediately.
12. Changes to this Privacy Policy
We may update this Privacy Policy from time to time — typically when we:
- add a new product or service;
- change a supplier;
- the legal landscape changes or our view of it.
We will notify you of material changes by email or visibly on the website at least 30 days before they take effect.
The current version is always available at cliqsales.com/privacy/.
13. Final provisions
- This Privacy Policy is governed by Irish law.
- If any part of the Privacy Policy is invalid or unenforceable, the remaining parts remain in force.
- In the event of conflict between this Privacy Policy and a separate DPA, the DPA prevails on matters of personal data of platform clients.
